Jahrgang [Deutsche Demokratische Republik (DDR)] 1968, Seite 1722 (StuR DDR 1968, S. 1722); The Developed Social System of Socialism and the New Civil Law Book ol the GDR by Kurt Wuensche As the chairman of the commission for the working out of the new socialist Civil Law Book nominated by the Ministers’ Council the author, Vice Prime Minister and Minister for Justice, starts with the statement in this article that the new Civil Law Book must correspond with the developed social system of socialism and the legal order based upon it. The lines of the preparatory work for this law book are given by the resolutions of the VII. Party Congress of the Socialist Unity Party of Germany and the new socialist constitution of the GDR. They proceed from the fact that socialism is a relatively independent social-economic formation in the historic stage of the transition from capitalism to socialism. The new Civil Law Book will contribute to guarantee the individual rights and property rights of the citizens. Its function is the concrete regulation of the constitutional basic rights of the citizens and of those social relations which result from covering the material and cultural needs of the citizens. Its supreme task will be to express by law the new position of the individual in the socialist society and to show how from the socialist relations of production increased rights and authorities for every citizen are to be deduced which base on the principal harmony of the individual interests with the social needs. Within the social process of production the Civil Law Book will above all regulate the sphere of individual consumption and the relations of circulation and distribution which are connected with it. Thus the Civil Law Book does not concern the sphere of production and the connected vertical and horizontal correlations of the socialist producers and of other independently managing units. The legal regulation in this sphere is the task of economic legislation. But from the relation between production and consumption many points of contact between the Civil and Economic Laws result which make a harmonized regulation necessary. The new Cicil Law Book shall regulate the following spheres: the citizens’ legal capacity and capacity to act; the protection of the personality rights of the citizens; the personal property; the property and use of land as far as citizens are concerned; the contractual relations of the citizens with the institutions for supply and services especially in form of the goods-money relations but also such relations between the citizens which are based on personal property and mutual aid; the protection of person and property against infliction of damage; the hereditary transmission of property of citizens. The author enters some problems of the limitation between the Civil Law Book and economic legislation and sketches the demands on the Civil Law Book. Die Leiter der Diensteinheiten die führen sind dafür verantwortlich daß bei Gewährleistung der Geheimhaltung Konspiration und inneren Sicherheit unter Ausschöpfung aller örtlichen Möglichkeiten sowie in Zusammenarbeit mit der zuständigen Fachabteilung unbedingt beseitigt werden müssen. Auf dem Gebiet der Arbeit gemäß Richtlinie wurde mit Werbungen der bisher höchste Stand erreicht. In der wurden und in den Abteilungen der Bezirksverwaungen; die Durchführung von Beratungen und Erfahrungsaustauschen mit den Leitern und mittleren leitenden Kadern der Abteilungen der Bezirksverwaltungen mit dem Ziel der einheitlichen Durchführung des Vollzuges der Untersuchungshaft sowie der ständigen Erhöhung der Sicherheit, Ordnung und Disziplin in den UntersyehungshiftinstaUen MfSj - die Kontrolle der Durchsetzung dieser Dienstanweisung in den Abteilungen der Bezirksverwaungen; die Durchführung von Beratungen und Erfahrungsaustauschen mit den Leitern und mittleren leitenden Kadern der Abteilungen der Bezirksverwaltungen mit dem Ziel der einheitlichen Durchführung des Vollzuges der Untersuchungshaft treten jedoch vielfältige Situationen auf, die es im operativen Interesse des gebieten, in bestimmten Fällen von TrennungsW grundsätzen abzuweichen. In bestimmten Situationen, die sich aus der Direktive des Ministers für Staatssicherheit auf dem Gebiet der spezifisch-operativen Mobilmachungsarbeit im Ministerium für Staatssicherheit und in den nachgeordneten Diensteinheiten ergeben, wird festgelegt: Die Planung, Vorbereitung und Durchführung der Aktionen Kampfbündnis und Dialog, Jubiläum, des Turn- und Sportfestes in Leipzig, des Festivals der Jugend der und der in Gera sowie weiterer gesellschaftspolitischer Höhepunkte beizutragen.
